KOTA KINABALU: Datuk John Ambrose sought leave from the High Court here for a judicial review against the Registrar of Societies' (ROS) decision that the KDM Malaysia's 2012 Extraordinary General Meeting and Annual General Meeting were in order.
Ambrose in filing the application for leave for judicial review at the High Court Registry on Monday, named the ROS as the first respondent and "KDM President" Dato Peter Anthony as the second respondent.
Ambrose's ex-parte application has been fixed for hearing on Sept 18.
In his statement, Ambrose claimed that a member of KDM Malaysia, Harry Ignatius Beatty filed a summons on July this year against the second respondent, Anthony, who was the vice president and treasurer KDM Malaysia, for purportedly taking over as president of KDM Malaysia without compliance of the Societies Act.
Ambrose said he had on April 2, this year written a letter of complaint to the ROS and received a reply on Aug 7. He said the ROS' decision was biased, unreasonable and unjust.
Ambrose believes that the ROS in issuing the said letter, ignored the rule of law and natural justice.
"There is no evidence that any Annual General Meeting 2012 was held in respect of the KDM Malaysia and the purported appointment of the second respondent as the president of KDM Malaysia is unlawful, null and void," said Ambrose.
He is seeking an order of Certiorari to quash the ROS' decision as set out in the letter dated Aug 7 which stated that as a result of their investigation into the applicant's complaint, the 2012 Extraordinary General Meeting and Annual General Meeting held by the organisation was in order and in line with the requirements of the law of registered organisations.
Ambrose is also seeking a declaration that there was no AGM conducted or held by KDM Malaysia and alternatively even if the said AGM was held, it was unlawful, null and void.
Ambrose is also seeking a declaration that he is the lawful and valid president of KDM Malaysia and a declaration that the second respondent is not and never was the president of KDM Malaysia.
He also seeking an injunction to restrain the second respondent from undertaking any duties or actions as the "President of KDM Malaysia", damages, costs and any other relief deem fit by the court.
Ambrose, who was accompanied by Beatty, filed the application through counsel Marcel Jude. (DE)
