MB can be outvoted if DAP, PKR exco reps stay


If DAP and PKR representatives remain on the Selangor executive council, Selangor Menteri Besar Abdul Khalid Ibrahim will find it difficult to make administrative decisions in state.

This is because, with support of only four exco members from PAS, Khalid and his "partners" will be in the minority.

"The MB claims he has support of the four PAS members of the 11 in the exco. With his vote, that will make five members voting in his favour on any issue in the exco.

"The remaining Pakatan Rakyat coalition (parties) has six members - three each from DAP and PKR.

"This means that the remaining Pakatan coalition can outvote the MB and his partners in the exco," Universiti Malaya law professor Gurdial Singh Nijar (left) said in an email to Malaysiakini.

He added that any advice given on the basis of the exco’s decision arrived at by majority vote, was binding on the sultan under Article 55 of the state constitution.

The article read: “In the exercise of his functions under this constitution, His highness shall act in accordance with the advice of the state executive council.”

Pakatan can hold power

This means that even if Khalid remains a party-less MB, Pakatan, through the exco, may wield "considerable power in the crisis now unfolding".

All Pakatan parties have told its representatives on the exco to stay put following PKR's decision sack Khalid as PKR member.

PAS, which has yet to decide if it will support Khalid to remain as MB, told its exco members to continue with their duties following Khalid's statement that the sultan consents to him staying on as MB.

Khalid today also said that he believes he has support from the four PAS exco members.

He added that he will meet all exco members to ask if they support him, and those who do not can resign.
