HOW TO HAVE FAITH IN THE JUDICIARY'S NEUTRALITY? Ban on Kim Quek's The March to Putrajaya stays
The Court of Appeal in Putrajaya today upheld the home minister’s decision to ban the book ‘The March to Putrajaya - Malaysia’s New Era is at Hand’ authored by political analyst Yong Thye Chong.
A three-member panel chaired by Justice Abdul Wahab Patail unanimously dismissed the appeal brought by Yong, 75, who is also known by his pen name Kim Quek, and the publisher of the 361-page book, Oriengroup Sdn Bhd.
They had appealed against a High Court decision delivered on July 15, 2011, to dismiss their judicial review application to challenge the home minister’s order to ban and seize 29 copies of the book from three bookstores.
Justice Abdul Wahab said the police were not prohibited by the Printing Presses and Publications Act 1984 from seizing the publications in the course of investigation.
He said that since the seizure of the books were not made under the Printing Presses and Publications Act, the judicial review which had relied on that act did not arise.
The other two judges were Justice Zaharah Ibrahim and David Wong Dak Wah.
Court of Appeal deputy registrar Zaini Fishir read out the court’s judgment in open court.
Yong was represented by lawyer Aston Paiva while senior federal counsel Noor Hisham Ismail appeared for the respondents - the home minister, the inspector-general of police, ASP Zul Azhar Mokhtar, ASP Mohd Fahmi Daraman Sah, Chief Insp Nahar Yamen and the government.
Aston told reporters that he would be applying for the court’s judgment before deciding on the next course of action. - Bernama
