Datuk Mahfuz Omar (PAS – Pokok Sena) was ejected from Chambers for refusing to heed the Speaker's advice and insulting the minister in the prime minister's department Datuk Seri Jamil Baharom. – The Malaysian Insider pic, March 26, 2015.Datuk Mahfuz Omar (PAS – Pokok Sena) was ejected from Chambers for refusing to heed the Speaker's advice and insulting a federal minister in Parliament today.
The veteran politician had wanted the minister in the prime minister's department Datuk Seri Jamil Baharom to state his personal stand on hudud, the Islamic penal code
He had also demanded to know if Putrajaya would be supporting the Private Member's Bill that Mahfuz's party president Datuk Seri Abdul Hadi Awang (PAS – Marang) wants to table in the current sitting, to enable the Islamic law to be implemented in Kelantan.
Mahfuz got further riled up when Jamil Khir revealed the amendment to the Shariah Courts (Criminal Jurisdiction) Act 1965 was never brought to the Rulers' Council.
An incensed Mahfuz shouted at Jamil Khir, calling the minister "menteri bacul" or cowardly minister.
Deputy speaker Datuk Ismail Mohamed Said's repeated instructions to Mahfuz to sit were ignored by the lawmaker, who continued to shout on top of his voice for nearly 30 minutes.
A clearly exasperated Ismail then proceeded to boot Mahfuz out.
"I am doing this because you ignored my directive to sit, and calling the minister names," said Ismail.
Later at the parliament lobby, Mahfuz questioned why the amendment was not brought to the rulers' council when the joint technical committee on hudud had agreed to it.
"The government had agreed to this, and now they break what was agreed, to bring this to the council," he said.
The PAS-led Kelantan assembly had unnanimously passed the Shariah Criminal Code II Enactment 1993 (amendment 2015) on March 19, to pave the way for the improvished east coast state to implement Islamic law, which among others, has provisions like death by stoning for adultery with married partners, whipping of between 40 and 80 times for consuming alcohol and amputation of limbs for theft.
The move has angered its allies PKR and DAP, who insist that hudud was not part of the opposition Pakatan Rakyat's common policy framework.
Ignoring its partners' protest, PAS president Datuk Seri Abdul Hadi Awang plans to table a private members’ bill in Parliament during the current sitting ending April 9.
The bill is to amend the Shariah Courts Act (Criminal Jurisdiction) 1965, which limits the power of the Shariah courts to a maximum penalty of RM3,000 fine, five years’ jail and six strokes of the rotan.
An amendment is required in this law to enable Kelantan to carry out hudud law.
