The Permatang Pauh seat is not vacant and Dewan Rakyat Speaker Tan Sri Pandikar Amin Mulia has breached the Federal Constitution with his premature announcement, says Datuk Seri Anwar Ibrahim's lawyer, Latheefa Koya.
In a statement, Latheefa today said Anwar's disqualification as Permatang Pauh MP was premature as no decision on the rejection of Anwar's petition for pardon has been communicated to Anwar or his family.
She said Anwar's family were the ones who made the application to the Yang di-Pertuan Agong.
"The Speaker's own announcement is only based on the communication by the Pardons Board and not by the Agong or the Palace. In short, no valid decision has been made and communicated as laid down in Article 42 read together with Article 48 of the Constitution," she added.
