Anina withdraws all lawsuits made in capacity as Umno member


Former Langkawi Umno member Anina Saadudin has withdrawn all her lawsuits made in her capacity as an Umno member.
This is in relation to her suit filed against Prime Minister Najib Abdul Razak which sought for the RM2.6 billion donation to be returned to Umno, her suit against Umno secretary-general Tengku Adnan Tengku Mansor and Umno executive secretary Ab Rauf Yusof over her expulsion from Umno, as well as her application to declare Section 18C of the Societies Act as unconstitutional.
Anina at a press conference today said the decision was made as she is now fighting through a new platform, that is, Parti Pribumi Bersatu Malaysia (Bersatu).
“Therefore, all my actions made in my capacity as an Umno member, or my action to challenge my expulsion from Umno, is no longer relevant.
“What's more important is that I will still continue with my fight but on a new platform – Bersatu," she told reporters at her lawyer Mohamed Haniff Khatri Abdulla's office in Kota Damansara today.
Anina, however, confirmed that her suit, filed together with former prime minister Dr Mahtahir Mohamad and former Batu Kawan Umno division vice-chief Khairuddin Abu Hassan against Najib for breach of fiduciary duty and misfeasance in public office, will continue.
“It is because it is not just an action taken in our personal capacity, but our noble fight taken on behalf of Malaysians.
“We will continue with this fight until it reaches the highest decision, Insya Allah (God willing)," she said.
'To the last drop of blood'
Explaining the reason for holding today’s press conference, Anina said it was to let all Malaysians know that her fight against Najib and the Umno leadership is still going on.
“It will be continued until the last drop of blood, as a noble fight which I started a year ago, albeit through a new platform,” she said.
Meanwhile, confirming that Anina had instructed him to withdraw the lawsuits, Haniff also gave his take on his client’s decision to do so.
“Anina became interested to join Bersatu (so) it is not a live issue for her to become an Umno member again.
“So it is not fair for Anina to ask that the courts listen to the cases. Anina thinks that the courts can use the time to listen to other cases involving live issues,” he said.
Haniff however admitted that he had somewhat regretted the decision as there were other points of law that could be argued in the hearings.
Asked if action could be taken against his client by the parties involved in the above mentioned lawsuits, Haniff said Anina had merely raised the issues through the courts and as such, this was not a basis for defamatory action to be taken.
“If the authorities feel like they want to use the laws (against Anina), although it is wrong, I believe Anina would be able to face the risks.

“According to the law, that shouldn't occur but if it were to happen, then it’s another case of persecution,” he said.
Anina was sacked from Umno in August last year, after she filed the suit against Najib to reclaim a portion of the RM2.6 billion donation.
In September, she filed the lawsuit against Tengku Adnan and Ab Rauf to challenge her sacking from the party. -Mkini
