PETALING JAYA: Singapore may be taken to the International Court of Justice in a last-ditch attempt by a Malaysian drug trafficker to escape being hanged in the republic.
“In order to stop the execution, the only way is for the Malaysian government to refer Singapore to the ICJ,” his lawyer told FMT.
“This is one of the ways to stop the execution because all of his domestic legal avenues have been exhausted. We have to urgently do this to save his life,” lawyer N Surendran said about his client’s attempts to overthrow his conviction in Singapore courts.
S Prabagaran faces execution in a few weeks’ time for drug trafficking. His mother handed over a memorandum to Putrajaya on Dec 21 to intervene.
“But, it seems like the government isn’t doing anything,” lawyer Surendran said.
He added: “It is also the Malaysian government’s responsibility for stand up for Prabagaran and every Malaysian abroad who is in trouble.”
The lawyer will file a judicial review at the High Court in Malaysia to compel Putrajaya to take the case to the global court, the ICJ.
Prabagaran was convicted in 2012 after 22.24g of diamorphine, a pure form of heroin, was found in his car at the Singaporean immigration checkpoint.
He has maintained his innocence, claiming that he didn’t own the car he drove and wasn’t aware of the drugs being in it.
He said he has also helped Singapore’s Central Narcotics Bureau to disrupt drug activities.-FMT
